Terms of Service — LocalPony

Welcome to LocalPony. These Terms of Service ("Terms") govern your use of the LocalPony mobile application (the "App") operated by Eastop LLC ("we," "us," or "our").

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use LocalPony. If you're between 13 and 17, you must have parental consent. By using the App, you represent that you meet these requirements.

2. Your Account

• You must provide accurate information when creating your account
• You are responsible for keeping your password secure
• You are responsible for all activity under your account
• Do not share your account or impersonate another person
• Notify us immediately at team@localpony.app if you suspect unauthorized access

3. Subscriptions and Billing

Free Trial

New users receive a 3-day free trial of Pro features. You can cancel anytime before the trial ends to avoid charges.

Subscription Tiers

• User Pro: $10.99/month
• Provider Pro: $19.99/month

Billing

• Subscriptions are processed by Apple through the App Store
• Payment is charged to your Apple ID at confirmation
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Manage or cancel subscriptions in your iOS Settings → Apple ID → Subscriptions

Refunds

All refund requests must go through Apple. We cannot issue refunds directly. See support.apple.com/refunds for Apple's refund policy.

4. Acceptable Use

You agree not to:

• Post false, misleading, scam, or fraudulent content (especially in classifieds)
• Include phone numbers, email addresses, or external payment information (Venmo, Zelle, CashApp, etc.) in classifieds listings — all buyer/seller communication must happen through the App's in-app messaging
• Harass, threaten, or discriminate against other users
• Post sexually explicit content, gore, weapons, or content that violates laws
• Impersonate another person, business, or organization
• Use the App for commercial purposes other than those it's designed for (e.g., bulk scraping, competitive intelligence)
• Attempt to hack, reverse engineer, or bypass security measures
• Upload viruses, malware, or malicious code
• Use automated tools to post or interact
• Sell or transfer your account
• Violate any applicable laws

Violation may result in content removal, account suspension, or account termination.

5. User Content

Your Content

You retain ownership of content you upload (photos, posts, listings, messages, etc.). By uploading, you grant LocalPony a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute that content within the App to make the service function.

Responsibility

You are solely responsible for your content. We don't verify the accuracy of listings, posts, or profiles. Other users rely on your information at their own risk.

Moderation

We reserve the right — but have no obligation — to:

• Review, edit, or remove content that violates these Terms
• Auto-hide listings that receive 3 or more user reports
• Use automated tools (like Sightengine) to scan uploaded images for prohibited content
• Suspend or terminate accounts that violate these Terms

6. Classifieds Safety Disclaimer

LocalPony is a platform that connects buyers and sellers. We are not a party to any transaction between users. We do not:

• Verify the identity of sellers or buyers
• Inspect or authenticate horses, tack, trailers, or other items
• Guarantee the quality, legality, or safety of any listing
• Process payments between buyers and sellers
• Mediate disputes or broker transactions

You transact at your own risk. We strongly recommend:

• Meeting in person before any transaction
• Getting a pre-purchase vet exam for horses
• Never wiring money or paying with gift cards
• Verifying ownership documentation (Coggins, registration papers)
• Using secure payment methods

By using the App, you acknowledge that LocalPony is not liable for any loss, damage, or injury resulting from transactions between users.

7. Third-Party Services

LocalPony integrates with third-party services including Supabase, Apple, Expo, Google Places, Open-Meteo, Sightengine, and Sentry. Your use of these services is subject to their terms. We are not responsible for third-party service outages or content.

8. Intellectual Property

The LocalPony name, logo, app design, and all content we create are owned by Eastop LLC and protected by copyright and trademark laws. You may not copy, modify, distribute, or create derivative works without our written permission.

User-generated content is owned by the respective users.

9. Termination

By You

You can delete your account at any time in Settings. All your data will be permanently removed within 30 days.

By Us

We may suspend or terminate your account if you violate these Terms, with or without notice. We may also terminate the App itself at our discretion.

Upon termination:

• Your right to use the App ends immediately
• Active subscriptions will not be refunded (subject to Apple's refund policy)
• Your content may be deleted

10. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The App will be uninterrupted, timely, or error-free
• Weather-based recommendations are always accurate
• Provider listings are accurate or up-to-date
• Defects will be corrected
• The App is free of viruses or harmful components

Blanket recommendations are guidance, not medical advice. You are solely responsible for your horse's care. Consult a veterinarian for medical questions.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EASTOP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP OR ANY TRANSACTIONS BETWEEN USERS. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold Eastop LLC harmless from any claims arising out of your use of the App, your content, or your violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law provisions. Any disputes will be resolved in the state or federal courts of Texas.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll notify you through the App or via email. Continued use after changes means you accept the new Terms.
